Specifications include, but are not limited to: The successful respondent(s) agree(s) to assume professional and administrative responsibility for all services addressed in these specifications, and to abide by all the requirements set forth by ECMCC as the covered entity in the 340B program. Successful respondents agrees to utilize the covered entity’s 340B Processor, Verity. 340B medication is purchased by ECMCC as the covered entity and ECMCC will maintain the title to the drug and be responsible for establishing its price. Only those 340B eligible dispenses that are a net benefit dispense to ECMCC will be accumulated for the purposes of replenishment. A successful respondent agrees that it will not resell or transfer a drug purchased at 340B prices to an individual who is not a patient of the covered entity. Respondents must: 1. Hold a valid pharmacy license in the state in which they operate. 2. Comply with all State and Federal laws governing pharmacy operation. 3. Provide comprehensive pharmacy services customarily provided to its customers or as otherwise required by law. 4. Demonstrate the ability to administer all aspects of a Section 340B outpatient drug program. 5. Be willing to engage in a contract pharmacy agreement that comports with all aspects of the 340B contract pharmacy guidelines at 75 Fed. Reg. 10272-10279. 6. Demonstrate the ability to perform its duties in accordance with such contract pharmacy guidelines, and in particular to implement, with ECMCC, an appropriate system for verifying patient eligibility and protecting against the diversion of 340B drugs. 7. Agree to a “bill to, ship to” procedure for 340B medications. The pharmacy will compare all shipments received to the order and inform ECMCC if there are any discrepancies with in five (5) business days or receipt.
