FOOD CONCESSION OPERATIONS OF FACILITY a. Successful vendor shall service and dispense as the County directs and provide quantities adequate for the needs of the public at the location indicated herein, subject to the terms contained herein: meaning foods, refreshments, confectionery, and beverages that conform to standards outlined in detail in these specifications, and as approved by the County. b. All Cafeteria operations shall be conducted in accordance with the times and schedules of operation indicated in these specifications, or as provided by the Director of the Division of Family Assistance and Benefits or designee. c. Bid shall be awarded as a concession, and the concessions shall be contracted “as is”. It is the responsibility of the vendor to inspect the premises prior to signing a contract with the County. The County makes no representation as to the condition of the equipment or premises, nor does the County guarantee the condition of any equipment. The successful vendor shall not rely on any statements or representations. d. Any additional equipment needed to operate concession is the responsibility of the vendor. e. Any changes not contained in these specifications must be submitted in writing to the Director of the Division of Family Assistance and Benefits or designee prior to the implementation of such changes. f. The privilege of installing and operating coin vending machines and devices is not permitted under the terms of this concession. g. Any menu price increases must be requested in writing, and must be approved in writing by the Director, or designee thereof, before vendor implements said increases h. Prices can only be increased once per year at, or near, the anniversary of the contract start date. i. There shall be no subsidy by the County of Essex other than for the initial equipment, space and utilities or as otherwise specifically provided under the terms of this contract unless agreed to in writing by the Essex County Director of the Division of Family and Benefits and the vendor.
