The scope of legal services to be provided include, but shall not be limited to the following: A. Litigation: Representation of THA as plaintiff in all lease termination matters in New Jersey Superior Court- Special Civil Part, and related proceedings and filings in connection therewith from filing of the summons and complaint to the conclusion of the eviction, including, but not limited to Special Civil Part Court hearings, warrants of removal and stay hearings, special tenancy hearings and the like. Representation of THA in matters related to tenant filings of bankruptcy petitions, including, but not limited to motions for vacating automatic stay, motions to dismiss, and similar. Representation of THA in resident grievance hearings. ( For RFP purposes: approximately 250 nonpayment of rent cases are filed per month. Cases are scheduled to be heard in court on two days per month. Approximately 20 tenants file bankruptcy petitions per year. ) B. Review, evaluate and make recommendations concerning individual tenant lease violation matters in conjunction with THA management, including, but not limited to preparation and review of Notices to Cease, Notices to Terminate and Demands for Possession. C. Provision of advice, opinions and recommendations to the Board of Commissioners and the Executive Director on issues relating to occupancy and tenancy. D. Attendance at meetings of the Board of Directors, resident councils and with THA staff as requested for discussions and advice regarding general occupancy and tenancy matters, case preparation, lease compliance, changes in landlord/tenant laws and HUD regulations, and the like.
