This is a Notice of Intent (NOI), NOT a request for proposal. The National Institute of Allergy and Infectious Diseases (NIAID) of the National Institutes of Health (NIH) intends to negotiate on an other than Full and Open Competition basis with Newport Corporation, 1791 Deere Ave, Irvine, CA 92606, United States, to procure a 12-Month Maintenance Agreement for Electron Microscopy (Em) Units.
The Research Technologies Branch (RTB) at the National Institutes of Health (NIH), (NIAID) Division of Intramural Research (DIR) requires a service plan for MKS Spectra-Physics instrumentation located in DIR labs. Due to the heavy usage, the systems must be calibrated and serviced periodically. In addition, they must be repaired quickly when failures occur. It is essential that the systems be restored to full operation as soon as possible. The plan must include parts, labor and travel necessary for remedial repair. It must also include remote (telephone or video) access to technical support and priority repair service response time of 24-48 hours.

Contractor requirements:
- One annual preventative maintenance inspection to be performed during a twelve-month period.
- Full coverage and unlimited on-site repairs, including Original Equipment Manufacturer (OEM) replacement for service parts, components, or modules necessary for repairs. Coverage includes all fees associated with repairs (labor and replacement parts) for any service or repairs performed unless quoted separately. Services will also include the travel and travel-related costs of service personnel necessary to perform the services on site where the equipment is located. *No Government furnished materials are provided under this contract.
- Prioritized scheduling and on-site response for all remedial services (critical repairs) during the period of performance. Priority is defined as giving priority scheduling equal to a direct contract and guaranteeing the equivalent manufacturer’s priority on-site response. If you are a third-party service provider, the priority scheduling and/or response time must be listed on your quote.
- Unlimited access to remote applications and technical support (troubleshooting and repairs) either by telephone or video conferencing capabilities during standard local time working hours.
- OEM Trained Certified Technician must be available during normal business hours to perform services. If third party, Documentation of OEM trained technicians required.
- 48-hour targeted response time for on-site applications support (troubleshooting and repairs).
- 48-hour targeted response time for all emergency repairs and all on-site visits
- Instrument firmware and software updates when available and upon request, and in conjunction with a scheduled Preventive Maintenance or Corrective Maintenance visit unless critical for operation of instrument. Provide End User License Agreement (EULA) if applicable.
- Unlimited service visits during normal business day hours, excluding Federal holidays.
- All invoicing is to be submitted monthly or quarterly in arrears.

The statutory authority for this sole source requirement is 41 U.S.C. 1901 (a) (1) as implemented by FAR 13.106-1 only one responsible source and no other supply of service will satisfy agency requirements. THIS IS NOT A REQUEST FOR PROPOSAL. All responsible sources that could provide this service may submit a capability statement to include evidence of being capable of providing priority service and a priority partnership with Newport Corporation. Requirement: *As priority status is only available with a contract with Newport Corporation, quotes submitted by third-party vendors must also include a contract with Newport Corporation to be considered, by 10:00 am EST, Thursday, May 15, 2025. All required documents must be submitted via the NIAID electronic Simplified Acquisition Submission System (eSASS) website at https://esass.nih.gov. All vendors must register in the eSASS system to submit their documentation. Instructions on how to register /submit documents are included on the website. All responses received by the closing date of this synopsis will be considered by the Government. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government.
