Specifications include, but are not limited to: Objective 1 Completeness and Compliance Review An objective of this procurement is to obtain third-party contractor support to assist DEQ in reviewing CR Kendall s operating permit amendment application for completeness and compliance with the substantive provisions of the Metal Mine Reclamation Act and associated administrative rules. In order to be complete, the application must contain the information required to be set forth in a permit amendment application under Section 82-4-335(5), MCA, and ARM 17.24.115 and 116. In order to be compliant, the proposed amendment and supporting analysis must satisfy the reclamation requirements and standards set forth in Section 82-4-336, MCA. The State has reviewed the application and believes that, at a minimum, the Contractor s review of the applicant s analyses regarding the following resources will be required to determine whether the proposed application is compliant: Hydrology - Water Balance Analysis of inputs and outputs and seasonal adjustments throughout closure and post-closure. Analysis of postmining water disposal, including process pad drainage, waste rock dump drainage, and potential use of a LAD area. Hydrology - Water Quality Analysis of the duration of water treatment needed for the process pad and waste rock dump discharges. This analysis includes evaluating the quality of water that exists near and immediately downstream of the mine area and reviewing the information contained in the Water Management Consultants 1999 report on background levels of thallium, arsenic, and selenium in the drainages of the South Fork of Last Chance Creek, Mason Canyon, Barnes-King Gulch, and Little Dog Creek. Discharges from the mine to both surface and ground waters may exceed water quality standards for certain contaminants, including arsenic, antimony, selenium, thallium, cyanide, and nitrate. Effects could be predicted by evaluating existing water quality data and analyzing the effectiveness of the proposed treatment system and of the cover system
