A. Lease of Premises. 1. The Proposer has the option to lease the property at 1735 Monad Road, which shall be negotiated under separate contract. 2. The City shall provide and maintain the facility in current status, for use jointly by City Animal Control and Proposer during the term of the contract. Layout in Attachment G. 3. The City shall be responsible for maintenance and repair of the facility, including lawn maintenance and snow removal for the grounds at the facility 4. The City shall be responsible for maintaining property insurance on the facility. 5. The Proposer shall pay the City an annual rent for use of the facility inclusive of all utilities. Annual rent will be broken down into 12 equal payments that will be subtracted from the monthly payment due to Proposer by the City under the Agreement. 6. Proposer shall assume responsibility for all cleaning and janitorial of the facility excluding the area occupied by City Animal Control. B. Commercial Requirements. 1. The initial length of this contract shall be two (2) years with three (3) 1-year options to renew by mutual agreement of both parties. 2. Should the Proposer opt to lease the facility, the City will retain ownership of the Animal Shelter during the initial five (5) years of the contract, but will consider allowing a proposer to purchase the facility at its appraised value upon renewal. 3. The proposed effective date of the contract will be January 1, 2026. C. Service. The successful proposer shall: 1. Operate the shelter in accordance with local, state and federal laws; and in accordance with the humane guidelines of a nationally recognized humane organization, such as the Humane Society of the United State, the American Society for the Prevention of Cruelty to Animals, or the American Humane Association. 2. Accept for refuge all animals brought in by any City' animal control officer or member of the public within the City or other participating jurisdiction. 3. Make every reasonable effort to locate owners of animals believed to be lost, strayed or stolen; if a previous owner cannot be found or an owner surrendered the animal, to find suitable homes for any animals believed to be adoptable; and to euthanize humanely and lawfully animals neither claimed nor adopted. 4. Maintain animals in suitable enclosures that provide adequate space to prevent overcrowding and to maintain normal exercise, according to species. Cages holding cats must contain a litter box for each cat. 5. Restrain animals by adequate fencing maintained at all times to contain the animals. 6. Provide at the proposer’s expense an annual inspection of the Animal Shelter to be conducted by the Humane Society of the United States or some equivalent agency to be mutually agreed upon during the contract process.
