Specifications include, but are not limited to: The contractor shall provide the provision of electronic monitoring and alcohol monitoring (hereinafter referred to electronic monitoring) for the Department of Corrections and the corresponding counties throughout the State of Missouri (hereinafter referred to as the state agency), in accordance with the provisions and requirements stated herein and to the sole satisfaction of the state agency. The contractor shall either provide the services directly or shall provide staff who must comply with the requirements stated herein. Therefore, references to “the contractor” throughout this document shall also be deemed to include the staff provided by the contractor. Preferred Use of Contract – The contract is being established and will be available for utilization by counties that elect to participate in the electronic monitoring program. Therefore, any city or county within the State of Missouri may participate in the contract. The contractor shall provide the services on an as needed, if needed basis. The State of Missouri does not guarantee any usage of the contract whatsoever. The contract shall be construed as a preferred use contract and shall not be construed as an exclusive arrangement. Preferred use means that any state agency needing the services should use the established contract unless it is determined to be in the best interest of the State of Missouri for a state agency to obtain alternate services elsewhere. For purposes of the contract, a state agency shall be defined as a division existing within a Department of Missouri State Government. The various sections, bureaus, offices, programs, boards, etc. that may exist within a division shall be considered all part of the same state agency. Additionally, for purposes of the contract, the term state agency shall be used to describe cities and counties utilizing the contract.
