PART 1 -TOWING SERVICES 1. The Contractor’s primary duty will be to respond, on a first priority basis, to requests for Police Generated towing services. TheContractor must be able to be on scene within twenty (20) minutes of initial contact with the Contractor 24 hours/day, 7 days/week, 365 days/year, including holidays and weekends. 2. The Contractor must undertake and complete these services to conclusion, using that standard of care, skill, and diligence normally provided by a professional person in performance of similar contracting services, to include debris, glass, and fluid removal/abatement. 3. The Contractor shall give priority to City calls, when requested; the Contractor shall provide immediate response to calls that involve a child locked in a vehicle or other emergency. 4. If the Contractor cannot comply with items 1-4, the Contractor must notify the City upon receipt of request for tow, at which point the Chief of Police or his/her designee will have discretion to request services from another towing provider until listed conditions can be satisfied. 5. While the Contractor has custody of vehicles, the Contractor will be responsible for its safekeeping, including contents, until it has been released to the owner or owner's agent, or otherwise disposed according to the law. 6. The proposer must meet all Section 304.154, RSMo., et seq., Towing Truck Company Requirements. 7. The proposer must meet all Cass County Missouri Code of Ordinances Chapter 600 sections 600.010 – 600.080. 8. While involved in tow operations for the City, the Contractor and/or employee(s) shall refrain from any acts of misconduct including, but not limited to, any of the following: 8.1 Rude or discourteous behavior. 8.2 Lack of service, selective service, or refusal to provide service that the operator is capable of performing. 8.3 Any act of workplace harassment,sexual harassment, or sexual impropriety. 8.4 Unsafe driving practices. PART 2 -OPERATING EQUIPMENT REQUIREMENTS 1. TheContractorshall meet the following operating equipment requirements: 1.1 The Contractor must have equipment capable of towing vehicles weighing seven and half tons (7.5). 1.2 Recovery truck(s) with an adjustable boom with a minimum lifting capacity of at least Seven and a half tons (7.5). 1.3 The Contractor’s tow vehicles shall be equipped with red flares or the electronic equivalent, lanterns or reflectors, hand tools, crowbar, rope, broom, shovel, dustpan, trash can, fire extinguisher, (dry chemical types), portable red tail light and stop light for towed vehicles, equipment for opening locked vehicles, safety snubbed chain, oil absorbent material to available at all times 1.4 If it is determined that towing capacity needed at the scene of a tow is greater than what the Contractor can provide at the time, the City has the right to contact another towing service provider who can provide the needed towing capacity.
