1. The services to be provided are to effectively and efficiently investigate police misconduct complaints received by Minneapolis Civil Rights Department and Minneapolis Office of Police Conduct Review (OPCR). This includes but is not limited to the following tasks: a. Plan investigations for cases as assigned; b. Take all reasonable steps to promptly identify, collect, and consider direct and circumstantial evidence necessary to determine the relevant facts, which may include but is not limited to officer-recorded audio or video taken with body worn cameras or other recording devices, and relevant evidence gathered in parallel criminal investigations or criminal or civil litigation to the extent not covered by attorney client, work product, or other privileges; c. Take all reasonable steps to locate and interview all relevant witnesses, including non-MPD officer witnesses, and attempt to interview any complainant or witness in-person at a time and place that is convenient and accessible for the complainant or witness, when feasible; witness statements are not to be disregarded solely because the witness has some connection to either the complainant or the MPD officer or because the witness or complainant has a criminal history; d. Determine whether there are any other open alleged police misconduct investigations involving the same officer in the same incident, and monitor or amend the complaint(s) or combine the investigations, as appropriate; e. Record all interviews via electronic recording, and document requests to reschedule; f. Take all reasonable steps to identify the subject MPD officer and witness MPD officer(s) if the complainant was unable to do so, or if additional subject and witness MPD officers are identified in the course of conducting the investigation; g. Identify training previously provided to the subject MPD officer relevant to the alleged misconduct; h. Identify inconsistencies, including descriptions of the evidence reviewed, where material inconsistencies exist between the complainant, MPD officer(s), and witness statements; i. Identify relevant policies implicated by the alleged conduct in the underlying incident, including any potential policies implicated that were not identified when the complaint was initially filed. Investigators must take all reasonable steps so that all alleged conduct that potentially violates policy is fully and fairly documented and is fully and fairly investigated, except for allegations that appropriate City staff determines are eligible for mediation, expedited disposition, or non-disciplinary corrective action; j. Conduct all tasks in compliance with the Peace Officer Discipline Procedures Act (PODPA), Minn. Stat. § 626.89, other law, and union contract, as applicable.
