The duties and responsibilities of an Administrative Hearing Officer are the duties and responsibilities as set out in the Administrative Enforcement and Hearing Process Benchbook for Hearing Officers (Included as Attachment C) and are expected to include, but not be limited to, the specific areas as follows: A. Evaluate written requests and authorize the issuance of an administrative subpoena for the attendance of a witness of the production of documents when appropriate. B. Make such rulings and take such action as deemed necessary to conduct a dignified and orderly hearing. C. Determine whether to allow opening and/or closing statements. D. Administer an oath or affirmation to each witness. E. Receive testimony and exhibits and give weight to evidence, including hearsay evidence, which possesses probative value commonly accepted by reasonable and prudent people in the conduct of their affairs.
