Specifications include, but are not limited to: The County of Kalamazoo is interested in entering into a contract with a person or firm to perform those Civil Process functions, with the exception of civil arrests, for the Sheriff’s Office. Specifically, the contractor would be expected to serve all summons not directed to departmental personnel, complaints, subpoenas, garnishments, writs of attachment, executions, claim and delivery actions, and writs of possession or restriction. The contractor must be at least eighteen (18) years of age, have proof of insurance as specified, and bonded employees at least eighteen (18) years of age. The contractor and his/her employees must be capable of being sworn as Special Deputy Sheriffs in order to legally serve process, and thus must all be U.S. citizens of acceptable moral character. All employees performing civil process functions under this contract must be Michigan Court Officers Deputy Sheriff’s Association (MCODSA) certified court officers. The contractor must have the capacity to serve 1,000 to 1,800 documents annually. The documents are to be picked up daily from the Sheriff’s Department, 1500 Lamont Avenue, Kalamazoo, Michigan 49048. The contractor must be familiar with the legal requirements of Civil Process and serve in the manner and form specified by law and in a timely fashion. If the contractor encounters difficulty or needs assistance in the service of process, then same will be brought to the attention of the Sheriff’s office no later than five. (5) days before the Statutory deadline for service. The contractor should not expect the presence and/or assistance of uniform personnel in the service or execution of Civil Process, except under extreme circumstances. The contractor must maintain a record system which includes all requests for service, status of all documents in process, files of all documents served and revenue and expense information. Weekly status reports to the Sheriff’s Office may be required regarding documents in process and any problems that have arisen. THE CONTRACTOR SHALL BE RESPONSIBLE FOR ALL BILLING TO CUSTOMERS AND COLLECTION OF PAYMENTS. No fees, charges or remuneration will be demanded or accepted in excess of that permitted by Statute, nor shall mileage be charged in excess of that established by Statute. The contractor must be familiar with State Statutes and Court rules that govern the Service of Process.
