A) The Contractor shall maintain, in good operating condition, the appropriate quantity and types of tow vehicles to meet the City’s needs. 1) Tow vehicles shall be capable of towing smaller vehicles and equipment as well as heavy vehicles and equipment in excess of 20,000 GVWR 2) Contractor shall keep an adequate number of these tow vehicles available within the City of Grandville at all times to fulfill the terms of the Contract. 3) All tow vehicles shall have two-way radio or cellular communication from its place of business to each wrecker. 4) All tow vehicles shall be maintained in good working order and in accordance with MPSC and MSP requirements and regulations. 5) All tow vehicles shall be clearly and permanently marked with the Contractor’s business name, address (city and state at minimum) and telephone number. ) This provision shall apply to towing and storage charges for a vehicle the bidder tows and holds at their lot that is described in subsection 1: 1) The circumstances involving the vehicle’s towing and storage meet the following: • The vehicle is being is subject to a police hold held because it is either: i. Evidence or potential evidence in a pending criminal investigation or prosecution; or ii. Was involved in an accident resulting in life threatening injury or death. • The vehicle is owned by an individual who is not either: i. Aa suspect in that crime or a related investigation or prosecution; or ii. At fault in the accident; or iii. a commercial entity. • The vehicle owner did not consent to its use by an individual who is either: i. A suspect in the crime for which the vehicle is being held or a related investigation or prosecution; or ii. At fault in the accident. 2) If the vehicle is released to the non-commercial vehicle owner or vehicle owner without available nofault insurance coverage or an individual or entity acting on behalf of the vehicle owner, the amount of storage fees that may be collected shall be the lesser of the following: • Bidder’s towing and recovery fees plus its contract lowest daily storage rate at its lot, or • Bidder’s towing and recovery fees plus $1,000. 3) Nothing in this provision precludes the bidder, in bidder’s sole discretion, from waiving all or any part of towing and storage fees for a vehicle the bidder tows and stores at the bidder’s lot.
