Specifications include, but are not limited to: conduct a due process hearing pursuant to the informal; adjudicatory Rules of procedure and MRC regulations (107 CMR 1:00 et seq.) as well as all pertinent rules of evidence. The impartial hearings officer shall be required to issue a decision based on the issues and evidence presented in accordance with State regulations and policies as well as good rehabilitation practice. The officer shall be required to conduct a hearing, which will assure that the rights of all parties to the hearing are protected, by eliciting relevant documentary evidence and eliciting pertinent testimony regarding the issues in controversy. The officer shall provide the decision in writing to either the applicant or eligible individual and to MRC. In addition, the officer shall provide the decisions electronically to MRC as directed.
