Scope The scope of services for this engagement includes, but is not limited to: an Administrative Review of Braintree Police Department (BPD) policies and procedures, including those required for BPD’s accreditation, an Administrative Review of BPD’s adherence to its policies and procedures; an Administrative Review of BPD’s adherence to the Town’s policies and procedures; an Administrative Review of BPD’s activities in the following areas: Professional Standards and Accountability; Organizational Structure and Governance; Citizens’ Privacy Protections; Management, Operations, and Culture; Hiring, Training Standards, and Equipment; Citizens’ Complaints Process; Conflicts of Interest; Seized Assets and Forfeiture Accounts Review; Evidence Review; Additional Administrative Items as detailed in this subsection 11 below; and complete a written summary and oral presentation of Conclusions and Recommendations for each area under Administrative Review. Also included in this scope is the identification of any policies and procedures typical of municipal policing that are absent from the BPD’s policy and procedure portfolio, along with the identification of any BPD policies and procedures that are out of compliance with federal, state and local statute, regulation or guidance, and/or generally accepted municipal policing standards. These standards include Massachusetts Peace Officer Standards and Training (POST) Commission standards, Massachusetts Police Accreditation Commission standards, Massachusetts General Laws, Code of Massachusetts Regulations, Massachusetts Police Training Commission, and the Town’s By-Laws and Ordinances. The review shall be conducted by an independent, unbiased, and impartial consulting firm that has no prior relationship with the Town and no conflicts of interest with Town employees, or Town board or committee members, or their immediate families. The independent reviewer shall work with the Town’s special project liaison, the Town’s Treasurer/Collector, who will likewise serve as liaison to the police department, and the reviewer will provide review progress reports to the liaison in a format and cadence dictated by the special project liaison. The independent reviewer shall have unfettered access to all aspects of the BPD, to include the ability to interview Town employees (inclusive of BPD employees) within the constraints of any applicable collective bargaining agreements, and with the option of anonymity where feasible. The Review shall include: 1. Policies, Procedures, and Regulations: a) Examine all existing policies, procedures, and rules governing police operations. This examination shall include, but not be limited to, an analysis of BPD rules/procedures pertaining to the monitoring of individuals in BPD custody. b) Examine adherence by the BPD’s staff to BPD’s policies and procedures. c) Examine adherence to the Town’s policies and procedures. d) Identify the absence of any policy and procedures commonly found in municipal policing. e) Review all federal, state, and local laws, regulations, and standards within the policies and procedures of the BPD and verify BPD’s adherence to those laws, policies and procedures. f) Review adherence to compliance with POST Commission standards, Massachusetts Police Accreditation Commission standards, Massachusetts General Laws, Code of Massachusetts Regulations, Massachusetts Police Training Committee, and the Town’s By-Laws and Ordinances. This review shall include the BPD’s undertaking of any self-assessment as a precursor to reaccreditation of the BPD by the Massachusetts Police Accreditation Commission.
