Specifications include, but are not limited to: 1. The successful Offeror/Proposer shall process raw USDA (United States Department of Agriculture) commodities into usable food products to be used by CCPS Department of Food and Nutrition Services (FNS) for such Federal programs as the National School Lunch and Breakfast program. As a participant in these Federal programs, CCPS is required to procure food and supplies in a manner that is compliant with Federal regulations contained in the Code of Federal Regulations (CFR), as well as any additional regulations required by the Code of Maryland (COMAR) and the CCPS school board policies. 2. All Offerors/Proposers, at all times, observe and comply with all laws, ordinances, regulations, codes, statues, and guidelines of the federal, state, county, and other local government agencies, having jurisdiction, which may in any manner affect the Contract, while meeting the project’s specifications and requirements. 3. All Offers/Proposers responding to this solicitation shall be responsible for adhering to the USDA “BUY AMERICAN” PROVISION in the National School Lunch Program: Section 104(d) of the William F. Goodling Child Nutrition Reauthorization Act of 1998 (Public Law 105-336) added a new provision, Section 12(n) of the NSLA (42 USC 1760(n)), requiring school food authorities to purchase to the maximum extent practicable, domestic commodities or products (Exhibit I); pursuant to 7 CFR Part 210.21(d), the definition of domestic commodity or product. 4. Buy American Labels must accompany all products. The successful Vendor/ Contractor must supply all nutritional information (nutritional label, product ingredients, allergens and child nutrition certification) in electronic format. Please submit, with your proposal, five samples of you packaging labels for different products.
