Specifications include, but are not limited to: The Contractor shall review each eligible request, including all supportive documentation, submitted to the Maryland Racing Commission by the holder of a racetrack license for a grant from the Racetrack Facility Renewal Account, established under Md. Code Ann., State Govt. Art., § 9-1A-29 Racetrack Facility Renewal Account , regarding racetrack facility capital construction and improvements. The Contractor shall assist the Maryland Racing Commission in determining if each such request is warranted and adequately supported under certain prescribed standards set forth in applicable statutory and regulatory provisions and make recommendations as to approval, denial, or modification. The Contractor may be required to review audited and unaudited financial statements of the racetrack licensee, proposed and actual budgets of the racetrack licensee, day-to-day costs of operation, and the racetrack licensee’s expenditure of matching funds (pursuant to a racetrack facility capital construction and improvements requirement). Regarding the reimbursement of operating expenses, the Contractor also may be required to determine if any costs of operation include, otherwise non-reimbursable, extraordinary income and expense-related items including extraordinary litigation costs, lobbying fees, capital investments (including predevelopment costs) or prior year adjustments and claims.
