a. The Contractor’s responsibilities within this Contract shall be as follows: Provide or subcontract with a Collection Site(s).The Contractor shall develop guidance documentation (checklists, sample agreements, etc.) to be used to secure collection sites for Calvert County Government. The collection site(s) shall be in full compliance with 49 CFR Part 40, which requires testing during all hours of Calvert County Government’s operations (24-hour, seven (7) days a week). This may include special circumstance requests i.e., postaccident, follow-up, and reasonable suspicion. The Contractor shall be directly responsible for the collection process. (1) Provide drug testing supplies and equipment from a listing of approved testing devices and utilize the forms as required by DOT (FMCSA and FTA). (2) Chain of Custody The Contractor’s collection site(s) and the selected testing laboratories shall establish a Chain of Custody procedure for all samples. The Contractor shall supply the proper testing kits and Chain of Custody forms, as required by DOT (FMCSA and FTA). (3) Develop a procedure to cover out of area travel with Calvert County Government vehicles within the State of Maryland. (4) Provide and preserve the option to add or modify the testing pools for administrative purposes to report and track all tests ordered under Calvert County Government authority. (5) Mobile Testing Provide or subcontract for mobile testing services made available on a 24-hour, seven (7) days a week basis. The Contractor shall be able to collect both drug and alcohol samples in accordance with the regulations. It is expected that this service will be utilized for Calvert County Government employees when their regular collection site is not available for a test. Such cases would most likely involve post-accident or reasonable suspicion type tests but could also include random testing at the request of Calvert County Government. 2) Laboratory Testing The Contractor shall be responsible for the selection of both a primary and secondary (for split sample purposes) laboratory for the testing of samples. a. The laboratories selected shall meet the following minimum standards: (1) Be certified by the Department of Health and Human Services; (2) Utilize an immunoassay technique to screen urine specimens for the specific illegal drugs; (3) Confirm all positive screens with gas chromatography/mass spectrometry; (4) Retain all confirmed positive specimens by the laboratory for a minimum of one (1) year or as required by DOT (FMCSA and FTA); (5) Provide secure storage for all split samples. If directed by the Medical Review Officer (MRO), the laboratory shall forward the split specimen bottle, with seal intact, a copy of the MRO request and the split specimen copy of the Custody and Control form to the secondary laboratory; and (6) Report results to Calvert County Government within 72 hours of the test or documentation shall be provided on the cause of any delay. 3) Chain of Custody The Contractor, in communication with Calvert County Government and selected testing laboratories and collection sites, shall establish a chain of custody procedure for all samples as required by DOT (FMCSA and FTA).
