The Arbitrator shall A. Analyze the agreement terms B. Draft or adopt forms to be used during the payment/arbitration process C. Establish a procedural framework for claims evaluation in alignment with the agreement D. Review the criteria and process for identifying eligible claimants E. Assist in establishing a submission process for affected individuals who object to their individual relief determination (e.g., application forms, deadlines, and supporting documentation) F. Review and adjudicate objection claims submitted by potential beneficiaries G. Ensure that the claims process is accessible and equitable for Black and female applicants H. Serve as the final decision-maker in cases where disputes arise concerning eligibility, allocation amounts, or related agreement matters I. Conduct informal hearings or document-based reviews, as necessary J. Work with all parties (Claims Administrator and the Department) to provide recommendations or decisions on the proportional distribution of funds among eligible claimants K. Ensure that allocation reflects the degree of impact and supports equity goals identified in the agreement L. Maintain clear records of all decisions and communications M. Submit interim and final reports to MDSP and other designated oversight bodies N. Maintain strict confidentiality of all claimants and agreement information O. Avoid any conflict of interest and adhere to ethical standards for neutral arbitrators in public matters P. Comply with Maryland’s public sector ethics laws and regulations
