Specifications include, but are not limited to: Preside over Title IX and/or related hearings, or select portions of hearings, involving students, staff and/or faculty. This will require: 1. Ruling on the admissibility of evidence; 2. Understanding the meaning of relevance; 3. Considering inculpatory as well as exculpatory evidence; 4. Applying the rape shield law and the exception thereto; 5. Applying the presumption of innocence; 6. Overseeing cross-examination; 7. Controlling the hearing, particularly in the presence of experienced counsel on one side and potentially no legal representation on the other; 8. Appropriately applying the “preponderance of evidence” standard of proof 9. Serving as the decision maker; and 10. Drafting a written determination of responsibility to include identification of allegations/charges, a description of the procedural steps taken from receipt of the formal complaint through hearing, findings of fact supporting the determination, conclusions regarding the applicability of the University’s code of conduct or related policies, and a statement of and rationale for the result as to each allegation and the determination of responsibility.
