Specifications include, but are not limited to: The Executive Branch Ethics Commission seeks to award a personal service contract to up to five (5) individuals qualified to serve as independent hearing officers for the Executive Branch Ethics Commission. Duties of the hearing officer will include, but will not be limited to, presiding at administrative hearings, adjudicating charges as stated in the Initiating Orders issued by the Commission, and preparing Findings of Fact, Conclusions of Law, and Recommended Orders for the Commission following the dictates of KRS 11A.100. Other quasi-judicial duties, which are incidental to the duties of a hearing officer, may also be assigned as required. Hearings will be conducted at 1025 Capital Center Drive, Suite 105, Shared Hearing Room, Frankfort, Kentucky 40601, unless otherwise specified. Hearing Officers selected by the Commission must maintain the training requirements provided in KRS 13B.030(4) and 40 KAR 5:010, Section 5(3). 9 KAR 1:030E provides that: (3) A person qualified to serve as a hearing office for the commission shall: (a) Maintain the qualification required by KRS 13B.040; (b) Be an attorney in good standing with the Kentucky Bar Association or otherwise have approval by the Kentucky Bar Association to practice law in the Commonwealth of Kentucky; (c) Demonstrate knowledge of KRS Chapter 11A by having served as an ethics officer, having previously served as a member or staff of the commission, or attending or participating in trainings offered by the commission on the requirements of KRS Chapter 11A; (training available, refer to Section 6 – Point of Contact for scheduling) (d) Not be a current member or staff of the commission; and (e) Not be under the jurisdiction of the commission.
