All project site work shall implement appropriate Best Management Practices (BMP) for access roads, grading, seeding/revegetation, site drainage, soil stabilization, and final reclamation in order to prevent site erosion and off site sedimentation. KRS 353.562 (c) provides that reclamation shall include: 1. Proper removal or abandonment of flow lines; 2. Removal and disposal of surface production equipment and debris; 3. Grading, stabilization, and seeding of the surface where the well was located; 4. Implementation of best management practices at sites associated with eligible wells; and 5. Removal or treatment of contaminated soil to no more than three (3) feet in depth. Following well plugging and casing cut off 3 ft. below surface, the pit shall be back-filled with earthen material to establish natural grade with the surrounding wellsite. The wellsite and access road shall be reclaimed utilizing best management practices (BMPs) which are vegetative, structural or managerial practices to prevent water or control water runoff from the site that may adversely affect surface waters and degrade the value of landowner property by excessive erosion of and sedimentation from disturbed areas. BMP’s segments include: Erosion Prevention: Wearing away of soil by running water must be prevented. Re-establishing vegetative straw mulch with seed mixtures Grading techniques of reclaimed areas by reducing grade Silt Fences Water Runoff Control: Identify natural drainage patterns for surface water by diverting runoff across the reclaimed area Diversion Ditches Water Bars (on access road) Culverts Sedimentation Control: Establishment of vegetative cover. • Re-establishing vegetative straw mulch with seed mixtures • Silt Fences • Establish temporary vegetative cover within 30 days. • Sites must exhibit a permanent vegetative cover with effective drainage for one year before sites will receive final acceptance and payment.
