Vendor shall submit a bid price for ALL districts to be considered for award. That bid price will be applicable to all locations within the geographical boundary of that District. By bidding and accepting a Contract, Vendors agree to treat the Department as a preferred and priority customer. Failure to do so may be cause for Contract cancellation. When service is not provided according to the Contract, the Division of Purchases reserves the right to make the purchase on the open market, with any cost in excess of the Contract price to be paid by the successful bidder. Except as provided herein, conform to all requirements of the Transportation Cabinet’s Current Standard Specifications for Road and Bridge Construction and the Special Note for Microsurfacing.
