Specifications include, but are not limited to: Working under the direction of the JJDPA Juvenile Justice Specialist for the Kansas Juvenile Justice Authority the Contractor shall: Perform the necessary compliance monitoring per requirements of the Juvenile Justice Delinquency Prevention Act of 2002 as amended (hereafter referred to as JJDPA) necessary to maintain Kansass eligibility for participation in the JJDPA Formula Grant and Title V programs. Maintain and update annually a written compliance-monitoring manual for JJA use by March 31. Draft policy and procedures as needed to maintain or improve state compliance. Maintain and improve an automated data collection system that will increase reporting efficiencies for reporting agencies and data manipulation for JJA. Create electronic reporting forms for use by detention centers (see Juvenile Secure Custody Detention Log). Work with members of the states law enforcement community to ensure the accurate recording and reporting of any juveniles held in secure custody as defined by JJDPA. Update and revise law enforcement secure juvenile holding log forms (see Detention Log Law Enforcement). Collect and review detention logs and law enforcement logs pertaining to all youth under age 18 who are processed or held securely in police custody or court holding facilities or other facilities as required under the federal JJDPA regulations. All violations must be cited and those agencies with violations will receive technical assistance as necessary to create corrective action plans to ensure future compliance. Calendar year reports for annual compliance monitoring due March 30th and state fiscal year reports for DMC matrices due September 31st. (see Juvenile Secure Custody Detention Log) Provide annual report of violations by judicial district on March 30. If judicial districts exceed the national violation rate, provide technical assistance to develop a compliance plan to address the violations by May 1. Work with law enforcement supervisory personnel to ensure that each agency has a current written policy regarding the management of juveniles in their custody including the training of their personnel in implementation of the policy. Such policies must be consistent with guidelines detailed in the JJDPA. Complete a 100% on-site inspection of all juvenile detention facilities and secure care facilities each year. Complete 33% of on-site inspections of police departments and other facilities that have capacity to provide secure detention of juveniles so that 100% of all facilities are inspected every 3 years. Annually complete a 10% on-site verification of all police departments and/or lockups, which report that juveniles are not detained or held in their facility. Annually obtain a written non secure certification from all police department and lock ups that report juveniles are not detained or held in the facility (see Non-Secure Certification Form) Provide on-site verification, annually, of at least 10% of non-secure juvenile residential facilities to determine compliance with appropriate provisions of the JJDPA and to inform staff and management of JJDPA core protections. Annually review and train staff of the Kansas Department of Health and Environment Child Placing Agency and Residential Programs Section, which is responsible for inspecting and licensing child care facilities, including residential centers, foster homes, juvenile detention, and secure care centers to incorporate JJDPA core protections. Annually review the following organizations capacity to securely hold youth pursuant with public authority and monitor accordingly: Kansas Department of Children and Families for foster homes, Kansas Department of Aging and Disability Services for mental health facilities and substance abuse placements, and Kansas Department of Corrections for adult correctional facilities. Annually review and train staff of the Kansas Juvenile Justice Authority to insure the JJDPA core requirements are enforced in Juvenile Correctional Facilities and intake and assessment centers. Monitor and review annually on-site 80% of court files that contain the valid court order exception used to securely detain status offenders (K.S.A. 38-2260). Draft the annual compliance monitoring report to the Office of Juvenile Justice and Delinquency Prevention for review by the Juvenile Justice Specialist by April 30. Draft the compliance sections of the 3 year plan and annual updates by December 31 of each year. Provide monthly narrative reports of activities by the 10th of the month. Upon request by the agency or upon violation history, develop JJDPA compliance and training plans for detention centers, law enforcement, intake and assessment, judges and prosecutors, supervision officers and others who may have the authority to securely confine juveniles in the state. Develop and deliver statewide training at three regional locations for significant changes in the act or where interpretations of act are necessary. Contract will be re-negotiated to include additional cost if regional training is required. Provide training and consultation to judges, prosecutors, sheriffs and other agencies regarding the JJDPA core requirements by most recent election cycles or upon request by the agency. In conjunction with the Juvenile Justice Specialist, the KAG, and JJA contractor shall work with other state agencies, community, municipal entities and the Governors Office to recommend draft policy, practice, and statute that ensures compliance with federal protections for youth in contact with justice system. Draft the compliance section of the annual report on the status of the States compliance to the Governor and Legislature by December 31. Maintain reliable personal transportation to perform site-visits throughout the State. Contractor shall be required to attend national and regional trainings and meetings when required by OJJDP. Contract will be renegotiated to include additional cost if training is required. Organize and lead a federal compliance monitoring audit in 2014 and every 5 years thereafter. Update and classify the monitoring universe on an annual basis for secure and non-secure facilities holding juveniles according to public authority by March 31 (See Monitoring Universe). Annually review Court, airport, educational and retail facilities that have or may develop secure holding capabilities by March 31 (See Monitoring Universe). Update a facility master list with the anticipated inspection schedule for the upcoming year including previous inspections by March 31 (See Monitoring Universe).
