The scope of services for this RFP requires the selected Contractor to be responsible for executing all aspects of each Purchaser’s drug and alcohol testing program pursuant to 49 CFR Parts 40 and 655, as amended. Proposers must describe the methodology used for addressing each of the following scope of service requirements. Services shall include the following outlined items: C.1. Specimen Collection and Drug Testing a) Describe in detail the method for providing each required service as outlined herein. b) Multiple collection sites throughout the State capable of handling all required tests must be established. Collection sites should be located within close proximity to the central office site for each of the individual Purchasers identified in Exhibit A. At a minimum RTAP-approved collection sites must be established within a 30-minute drive of each Purchaser’s operating base. Sites located further than this requirement must be justified to RTAP’s satisfaction. c) For post-accident, reasonable suspicion, random, return-to-duty, and followup testing, collection services must be available during all days and hours that each respective transit system has covered employees performing safetysensitive functions. If the primary collection site is not open during all days and/or hours testing is to be performed, an alternative method for after-hours collections must be described that is deemed acceptable to and approved by RTAP. Collection sites must be mutually agreed upon by the respective Purchaser and the Contractor before the collection site can become a permanent collection site for the contract period. d) Proposers must describe in detail how they will allow for oversight activities, to include validation of collector, technician and BAT training, verifying calibration requirements for EBTs, annual “mock” collections for both breath alcohol testing and specimen collections; and approval and review of restrooms used for specimen collections in accordance with 49 CFR Part 40.43. e) Implement the collection process conforming to all applicable Federal and State requirements for breath alcohol testing, split specimen urinalysis, and oral fluids collection for drug testing, recognizing that in the event of a conflict in law, the regulations in 49 CFR Part 40, as amended, govern; take measures to prevent test cancellations; and transport specimens from collection sites to the appropriate lab(s) within 24 hours or the next business day of the time of collection. f) Establish testing by a laboratory which has been certified by the Department of Health and Human Services (DHHS) under the National Laboratory Certification Program (NLCP), consistent with 49 CFR Part 40.81 Such laboratory must remain certified throughout the term of this contract. g) At such a time that at least two (2) laboratories have been certified by DHHS to conduct oral fluid specimen testing for USDOT drug tests, the proposer must immediately establish testing by the appropriate labs to allow for the option of USDOT compliant oral fluid specimen collections for all Purchasers in the State. h) At such a time that oral fluid specimen testing for USDOT drug tests becomes available please describe how the “standing order” for each providers testing preference will be managed (49 CFR Part 40.210). i) Negative test results should be reported within forty-eight (48) hours of receipt by the laboratory. Positive tests results should be reported within seventy-two hours of receipt by the laboratory. The specific time frames are from the time of delivery to the testing laboratory to the time of the MRO notification. j) Provide the services of a second DHHS-certified laboratory for the testing of split specimens. The second laboratory must meet the same requirements as those specified for the primary laboratory. Develop procedures for the transfer of the split specimen from the primary laboratory to the secondary laboratory taking precautions to ensure the integrity of the split specimen test is not compromised or the specimen is not lost or mishandled.
