1.3.1. This Contract allows for the establishment of regional towing service locations and vendor listings to provide services for each identified garage region. Garage region towing services vendors shall be managed and maintained by the State’s representative at CMS DOV assigned to the region. 1.3.2. The primary vendor will have right of first refusal. In the event the primary vendor is not able or not willing to meet the State's needs, the State reserves the right to utilize other vendors and procurement methods if necessary. 1.3.3. Vendor, when requested, shall provide towing services 24 hours a day – 365 days a year. 1.3.4. Vendor shall respond to requests for towing services within one hour after the State’s request for towing services and provide an estimated time of on-site services. An adequate method of response must either be a verbal or written form of communication. 1.3.5. Vendor shall provide towing services for all types and sizes of government vehicles. Examples of types of vehicles are but not limited to: passenger, SUVs, light duty trucks, including fossil-fuel, hybrid-electric, and electric vehicles. 1.3.6. Vendor shall follow all applicable practices and standards set forth by the Occupational Safety and Health Administration (OSHA) when performing towing services. 1.3.7. Mileage charges for towing services shall be charged at the agreed mileage rate set forth by the contract line items. The Vendor shall not charge CMS DOV additional fees to provide this service. 1.3.8. Vendor shall invoice by rounding up to the nearest mile if between .6 and .9 miles or round down to the nearest mile if between .1 and .5 miles. Milage is counted from the agreed pick-up to drop off point.
