Specifications include, but are not limited to: 1. Meeting with the STATE to determine the specific features of the Program, as requested by the STATE. a. Key meetings (as reasonably requested by the STATE) shall be held in person. Other in-person meetings shall be held as mutually agreed to by the parties. b. Except as otherwise provided herein, communication by video- conferencing, telephone, facsimile, U.S. mail, and e-mail may be used by the parties. 2. Assisting the STATE in setting the minimum and maximum contribution amounts, the minimum length of time required before a distribution can be made, a “more than de minimis penalty” (to the extent required by the Code) on all nonqualified withdrawals, and other features of the Program. 3. Ensuring that the Program is designed, implemented, and coordinated (and remains) in compliance with Section 529A of the Code and all other applicable federal and STATE laws, rules, and regulations.
