Specifications include, but are not limited to: The contracted evaluators’ tasks and responsibilities shall include, but may not be limited to, completing evaluations ordered out of the District, Family and Circuit courts of Hawaii. Pursuant to Hawaii Revised Statutes Chapter 704, whenever a defendant has filed a notice of intention to rely on the defense of physical or mental disease, disorder or defect, or there is reason to doubt the defendant’s fitness to proceed, the court may immediately suspend all further proceedings in the matter. The courts then appoint three (3) qualified examiners in felony cases and one (1) qualified examiner in non-felony cases to examine and report upon the defendant’s physical and mental condition. Specifically, a contracted evaluator (examiner) will have the responsibility of opining on fitness, penal responsibility and/or dangerousness of an ordered defendant. A contracted evaluator will have the responsibility to respond to any and all other components of the order, as well.
