1. The CITY will provide the PREMISES on an "AS IS, WHERE IS" basis. 2. The CONCESSIONAIRE shall have the exclusive right to manage and operate the PREMISES provided for the purposes stated herein during the CONTRACT period. 3. The CONCESSIONAIRE shall prioritize enrollment for the children of CITY employees in the child care facility, provided that space is available. Enrollment shall be offered on a first-come, first-served basis. The CONCESSIONAIRE shall maintain a waitlist for all applicants, with CITY employees’ children given priority placement in accordance with this provision and applicable law. The prioritization of available child care services within child care facilities on CITY property recognizes the CITY’s policy of becoming a model employer in the delivery of child care services to its employees, as stated in Section 11-1.1(3), Revised Ordinances of Honolulu 2021, as amended.
