Equipment a. Contractor will furnish, install, maintain, service, repair and/or replace vending machines at no charge to the University. All vending machine placements must be new or like-new, state-of-theart equipment, ensuring it remains so throughout the term of the contract should there be a significant change in equipment technology. At no time during the contract term or renewals, will any vending machine be on location more than five (5) years from date of installation. Exceptions may be granted at the sole discretion of the University’s Vice President for Business & Finance (VPBF). b. All vending machines will remain the ownership and property of the Contractor. c. All machines will be maintained and in proper working order at all times. d. Vending machines will not be operated in a "force vend" mode; machines will be programmed to return customers' money or credit card, if a selection is not available or a sale is voided. e. All vending machines must comply with all Federal, State, and County Codes. All machines must comply with current Americans with Disabilities Act guidelines and/or any FDA labeling guidelines changed during the life of this Contract. f. All machines must be able to accept, at a minimum: Cash, Credit/Debit, and mobile payment methods like Android and Apple Pay. a. All credit/debit card processing must be done via cellular or dedicated network connections installed, maintained, and paid for by the vendor. b. Contractor agrees to attest that all credit/debit payment processing takes place on a PCI DSS compliant network. c. Contractor agrees to hold the University harmless from any loss or damage that may arise because of the failure of any utility. d. The areas surrounding all machines are to be kept clean and the responsibility of The Contractor. e. Vending machines shall be operated during the entire year, but with reduced selections in areas of campus, arrived at by mutual agreement, for the University vacation breaks. The Contractor shall meet with the University Representative in April/May to determine needs for summer camps and conferences, summer residents living on-campus and students taking spring/summer classes as many buildings remain open but some will have reduced traffic. f. The University recognizes that the Contractor may have unique vending solutions not currently offered at Savannah State University and is open to recommendations and solutions if space and opportunity allows.
