The Ponce Inlet Town Council aims to enhance the health, safety, and welfare of its citizens by appointing a Special Magistrate for code enforcement. This Special Magistrate will have the authority to impose administrative fines and other non-criminal penalties, ensuring a fair, efficient, and effective approach to enforcing Town codes and ordinances. The scope of work may include the services outlined, as well as any related tasks within their expertise. The Special Magistrate will hold the same status, powers, and responsibilities as a Code Enforcement Board, as defined in Chapter 162 of the Florida Statutes. The Special Magistrate shall have the same status, powers, and duties as a Code Enforcement Board as prescribed in Chapter 162, Florida Statutes, as may be amended. In particular, the Special Magistrate shall have the power to: (1) Adopt rules for the conduct of hearings. (2) Hold code enforcement hearings and assess fines against violators of the various codes of the town. (3) Subpoena alleged violators and witnesses for hearings. (4) Subpoena evidence for hearing. (5) Take testimony under oath. (6) Issue orders having the force of law commanding whatever steps are necessary to bring a violation into compliance or otherwise resolve an administrative matter in accordance with the Code. (7) Review and provide recommendations to the Town Council regarding cases suggested for foreclosure. (8) Hear certain appeals as provided by the Town’s adopted codes and regulations.
