Special Magistrate services shall be provided by an attorney and member of the Florida Bar or retired Judge, who shall be appointed by the City Council to preside over traffic infractions, code compliance and Florida Building Code matters and who may be discharged by the City Council at its discretion, with or without cause. The Special Magistrate shall have the jurisdiction and authority to hear and to decide alleged violations and exercise the powers as provided in F.S., Ch.162 and the City’s Code of Ordinances Chapter 1. Division 2 – Special Magistrate. The City does not warrant that the Special Magistrate will be scheduled to serve any particular number of days or hear a specific number of cases. However, in some instances, a Special Magistrate may be scheduled to hear exceptional cases on one full day or during consecutive days. In these extraordinary instances, the Special Magistrate may request additional time to complete his or her findings. The City shall provide the hearing rooms for all Special Magistrate hearings and shall be responsible for the costs of recording all hearings before the Special Magistrate. The City will provide the Special Magistrate with sufficient forms for the completion of his or her findings of fact and conclusions of law for each hearing. All clerical expenses incurred by the Special Magistrate in the performance of this Agreement shall be borne by the City.
