Task 1: Solid Waste Franchise Agreement Implementation and Tracking The City’s Solid Waste Franchise Agreement (“Franchise Agreement”) describes the collection, transportation, processing, and diversion of municipal solid waste, recyclable materials, organic materials, and construction and demolition debris, which are implemented through several programs. Consequently, multiple reports are submitted by Waste Management tracking the performance of these efforts. The Franchise Agreement requires Waste Management to implement all State-required programs and to meet all other new State-mandates for diversion and recycling. The Consultant shall provide professional services to the City for implementation and tracking of activities performed under the Franchise Agreement. Generally, the activities can be categorized into the following subtasks: Task 1.1: Program Implementation Tracking Develop and maintain a tracking system that aggregates time sensitive contractual and compliance obligations that are not tracked in the City’s solid waste program software, Recyclist. This is a live document which shall be updated based on the time schedule in the Franchise Agreement, regulatory requirements and the analysis of the monthly, annual, and quarterly reports from Waste Management (Task 1.2 below). The live document shall be posted within an online file sharing site which can be viewed and edited in real-time by the City (e.g. Google docs) and updated within 20 days of the receipt of any report(s) from Waste Management. The intent is for the tracking information to be consistently updated for easy access by City staff. Task 1.2: Report Analysis Review Waste Management’s submitted data in monthly, quarterly and annual reports and identify areas of inquiry that are then typically reviewed at the monthly meetings (See Task 3). This analysis will identify and report to the City any deficiencies in program implementation, including the regulatory compliance, to be resolved with Waste Management, and may include follow-up site visits and field verification with Waste Management’s representative. Task 1.3: Waste Characterization Oversight Oversee Waste Management’s semi-annual waste characterizations to assess the quantity and types of materials found in the different waste streams collected by hauler, including SB 1383 contamination levels, identification and calculation of diversion tonnage. This may include fieldwork, as needed, to verify diversion tonnage and perform general spot checks. Task 1.4: Monthly Meetings and Coordination Coordinate program implementation tracking through monthly meetings with the City and Waste Management, which will be held at City Hall in order to keep an open line of communication between all parties and to clearly communicate the City’s expectations and programmatic requirements with Waste Management. Task 1.5: Other Franchise Agreement Implementation Tasks Other Franchise Agreement implementation tasks may include disposal analysis and tracking, review of annual rate adjustment described in the Franchise Agreement (inflation and pass though cost rate increase), commercial and residential organic waste program implementation tracking, periodic audits of required color/marking, appearance/conditions of bins, and any other tasks related to proper implementation of the Franchise Agreement. Task 2: Regulatory Reporting Support Assist in preparation of CalRecycle reports including, but not limited to, Electronic Annual Reports and 303 Report. Participate in conference calls and annual tours with CalRecycle as scheduled. Oversee City’s Generator Compliance Notification Process including drafting letters, developing self-reporting forms, managing responses, and tracking implementation progress for the following notifications: AB 341 – commercial, AB 341 – multi-family, AB 1826 – food service establishments, AB 1826 – landscaping waste generators, AB 341/AB 1826 – schools, AB 927 – food waste separated containers, and SB 1383 – organics recycling and edible food recovery. Task 3: Legal Assistance As needed, assist in interpretation of the Franchise Agreement and SB 1383 regulatory requirements and provide recommendations. If updates are needed, assist in reviewing potential changes to the City’s Solid Waste ordinances to ensure effectiveness in implementation of all programs under the Franchise Agreement. Specifically, ensure any ordinance changes developed by the City Attorney’s office provide what is needed to secure field compliance with any regulatory requirements.
