It is the intent of this Agreement to divert recyclable materials from landfill disposal. The Contractor shall pick-up, remove, and recycle all materials identified on the Exhibit B-1, Rate Sheet through various means, to prepare them for sale into recyclable commodity markets. The Contractor may charge one (1) service fee per request for services, not per item type to be picked up. The Contractor shall make every attempt available to ensure all recyclable materials are picked up on the same trip to the institution/facility and not separated by pick-up material type. The Contractor will be compensated for services performed in accordance with the service fee, minus the value of the recyclable materials retrieved from the institution/facility in the event a profit is made for such items. If a profit is not made on mixed wood that is removed (as identified herein), the Contractor will be compensated for the removal in accordance with the applicable rate(s) on the Exhibit B-1, Rate Sheet. Recyclable materials removed from CDCR grounds shall be documented on an Exhibit A-2, Pick-up Ticket. Materials including but not limited to plastics, metal, or glass, shall be recycled at sites that recover and recycle items specifically for another use. The Contractor shall provide recycling container(s) to remain on-site at the institution/facility, on an as needed basis, unless otherwise specified by the CDCR Contract Liaison or designee. The Contractor shall provide the size, type, and number of containers upon request of the CDCR Contract Liaison or designee, as specified on Exhibit A-1, Container Information. CDCR reserves the right to increase or decrease the type and/or number of containers to accommodate any volume of recyclable materials and will be requested in writing by the CDCR Contract Liaison or designee. Additional containers shall be provided by the Contractor at the Contractor’s expense. There will be no charges to CDCR for the removal of containers or a decrease in services. The Contractor shall deliver the containers to the location specified on Exhibit A-1, Container Information, unless otherwise specified by the CDCR Contract Liaison or designee, prior to delivery. The container location can be changed at any time, at the discretion of CDCR. CDCR will provide a minimum of twenty-four (24) hours’ notice to the Contractor of any container location change. Institutions/facilities may choose to utilize State-owned containers, as identified on Exhibit A-1, Container Information. Any comingled recyclable materials shall not be removed from institution/facility grounds, unless agreed upon by the CDCR Contract Liaison or designee. Any comingled recyclable materials removed from the grounds by the Contractor shall be the Contractor’s responsibility to separate at the Contractor’s expense. The Contractor shall advise the CDCR Contract Liaison or designee in writing of any issues found with recyclable materials removed from the institution/facility. This includes reporting improper packaging and other problems that may affect the recycling of materials. Any such issues shall be reported within five (5) days of their discovery. The CDCR Contract Liaison or designee will investigate the issue and ensure corrective action is taken. The Contractor shall provide baling wire at no additional expense, as needed, upon CDCR request. Additional compensation will not be provided for travel time, meals, lodging, or time involved with entering or exiting the institution/facility. Zero ($0.00) and/or negative (-) dollar reimbursement amounts on Exhibit B-1, Rate Sheet will not be accepted. The Contractor shall ensure they are prepared and fully equipped to provide all requested services to each awarded location. The Contractor must demonstrate adequate staffing and resources to ensure that all locations receive timely services. In the event of a failure to perform services within the requested timeframe, the State reserves the right to request the Contractor to assign additional resources, such as subcontractor use, at no additional cost to the State.
