Assessor’s parcel number (APN) 044-260-004 is a 0.53-acre lot located on the corner of McKinstry St. and Soscol Ave. (the “Property”) in the City of Napa. The Napa County Flood Control and Water Conservation District (the “District”) purchased the Property, as part of a larger property, in 2005 in relation to the Napa River/Napa Creek Flood Protection Project (the “Project”). The Property is vacant and unimproved. The Property has frontage on both Soscol Avenue and McKinstry Street with commercial to the South and commercial hospitality to the East and North. The Property is encumbered with an approximately 25 foot wide Napa Sanitation easement for the purpose of an underground pipeline. Concurrently with the close of escrow, the Parties shall enter into a right of entry agreement, granting the District access to the Property until December 1, 2027, for the purpose of construction staging in relation to future work for the Project. The Property is legally described in the Preliminary Title Report attached herein as Exhibit “A.” ZONING The general plan designation is Downtown Specific Plan/Oxbow Commercial and the zoning is Oxbow Commercial – OBC which allows for use oriented to tourists such as hotels and their related amenities, recreational facilities; community and visitor-serving retail, commercial entertainment, and restaurants; and similar compatible uses in addition to residential and live/work opportunities.
