A. (SUCCESSFUL BIDDER) hereinafter referred to as “Contractor,” agrees to provide to the California Department of Tax and Fee Administration, hereinafter referred to as “CDTFA” or the “State,” transportation and facilities adhering to all State and Federal codes and regulations, necessary to safely and responsibly pick up, remove, transport, and destruct hazardous wastes that pose a potential threat to life, public health, public safety, public welfare, property, and/or the environment. Hazardous waste shall include, but not be limited to, liquid nicotine, and various types of batteries to include lithium-ion batteries as described herein. In addition, Contractor shall be required to dispose of non-hazardous cannabis oil products and other cannabis products in various forms; The Contractor must not schedule any other pick-ups from other customers while providing pick-up and destruction services for CDTFA. The Contractor shall provide. CDTFA will allow the Contractor flexibility in this process if the Contractor can maintain clear separation of CDTFA’s waste products from other customers’ products and the Contractor can provide documented proof (confirming content and weight) of destruction of CDTFA’s waste products. The Contractor and CDTFA or the State shall be together referred to as the “Parties.” B. Contractor shall provide service on a regularly scheduled basis, and occasionally on an as needed basis, for CDTFA’s Northern California, Southern California and Central Valley California Tax Investigations and Inspections Bureaus (TIIB’s) storage locations to be prescribed by CDTFA. The CDTFA estimates it will need waste pick-up services four (4) times per year, per facility. These are only estimates and not a guarantee of service level and waste volume. Contractor shall also provide scheduled emergency pick-ups within 24 hours after notice of an emergency need, at the request of either TIIB’ Evidence Custodian, or their designees. If there is insufficient waste at the CDTFA’s warehouse to merit pick-up on a regularly scheduled waste pick-up day, the CDTFA may cancel the scheduled pick-up by providing the Contractor with 24 hours’ notice of the cancellation. Contractor shall invoice for, and the CDTFA shall pay for, only waste pick-ups actually made, and not for any timely cancelled pick-ups.
