A. Contractor shall perform guardrail and other highway component repair and replacement services as described in this Agreement. All materials used must be preapproved, in writing, in advance of purchase by Caltrans Contract Manager. All materials used shall be new and conform to all requirements set forth in this Agreement, including, but not limited to, all Standard Specifications and Standard Plans cited in this Agreement. The types of services to be performed by Contractor are listed below in Section 9, Services to be Performed by Contractor. B. Any work or materials that may be found to be substandard or out of compliance with code will subject Contractor to a call back to redo the job and bring the job up to standard or code. Any such call back and any such materials required will be at Contractor’s sole expense. If poor work by Contractor persists and necessitates a third “call back” to complete/correct job(s), Contractor is hereby advised, and Contractor agrees, that this poor work record will constitute grounds for Contract Termination pursuant to Exhibit D, at the sole discretion of Caltrans Contract Manager. C. Should a supplemental repair or replacement, be requested from Caltrans Resident Engineer or Caltrans Contract Manager that is not on the bid sheet, an equivalent may be used with proof of like cost from Contractor and prior approval from Caltrans Contract Manager. D. Contractor shall submit the manufacturer’s checklist for each device repaired, in connection with each Service Request, Attachment 3, signed by Contractor, to Caltrans Contract Manager, and the approval of same by Caltrans Contract Manager will be obtained after installation and prior to payment approval. E. Contractor shall supply all materials necessary to complete all reconstruction and/or replacement of guardrail systems in accord with this Scope of Work, and the cost for all of same shall be included in Bid Proposal, Attachment 1 for each item. All miscellaneous hardware required, including bolts and fasteners, shall be considered as incidental and included in the Agreement unit price for each item of reconstruction, installation, or assembly. For reconstruction, installation, and assembly, all blocks and posts required shall be provided by Contractor and shall be included in the Agreement unit price for each item. Blocks and posts used without guardrail work shall be listed under Activity 6 on Bid Proposal, Attachment 1. F. Contractor is responsible for any and all earthwork (i.e. dike, embankment, berm or dirt removal) necessary in conjunction with all work performed pursuant to this Agreement, and Contractor is responsible for disposing in a legal manner all damaged highway components removed (remove and dispose of) in the course of all work performed pursuant to this Agreement. G. Reconstruct is defined as: to remove and disassemble and construct again at an existing or new location, using existing parts/components) and/or install (to place in position or connect for service or use using new parts/components). H. Contractor shall deliver services that complete each of the tasks in a commercially reasonable manner; that produce the deliverables described; and that satisfy the prevailing commercial standards, the Standard Specifications and Standard Plans cited in this Agreement, all legal requirements, and all other requirements set forth in this Agreement that are applicable to each task and deliverable. In the event of any conflict between prevailing commercial standards and any provisions of this Agreement, including but not limited to, the Standard Specifications and Standard Plans cited in this Agreement, the provisions of this Agreement and such Standard Specifications and Standard Plans shall govern. I. No move-in/move-out will be paid on equipment. No per diem will be paid. No additional payment will be made for travel time to and from the job site.
