Upon completion of the feasibility phase and community feedback, upon direction from the City, the consultant shall support the City through the legal formation process of the BID, including: 1. Preparation of Legal Framework & Resolution of Intention • Drafting a statement that a BID is proposed under the California BID Law • Defining BID boundaries • Describing the types of proposed improvements and activities (e.g., public safety patrols, marketing, street maintenance, event promotion) • Specifying that assessments will be levied annually to fund BID activities, except where other funds are available • Providing a proposed method and basis of assessment (e.g., square footage, percentage of revenue, etc.) • Addressing exemption policies for new businesses (e.g., up to one year from opening) • Identifying time, date, and location for public hearing consistent with noticing requirements • Clarifying that testimony and protests will be accepted at the hearing 2. Implementation of BID Formation Process • Support the establishment of a BID Advisory Board to recommend assessment use and structure • Mailing and publication of joint notice for public meetings and hearing • Conducting a public meeting and preparation of the Resolution of Intention • Conducting a public hearing, receiving testimony and protests • Supporting City Council adoption of ordinance to establish the BID • Providing clear, accessible materials throughout to ensure transparency and reduce the potential for protests...
