Specifications include, but are not limited to: 1.2.1.On behalf of and as directed by the DOI, the contractor will provide insurermarket conduct examination services for all types of insurers. As such, the contractor willprovide one or more of the following services upon the request of and as directed by theDOI:1.2.1.1. Conduct market conduct examinations of insurers in accordancewith the Market Regulation Manual of the National Association of InsuranceCommissioners (NAIC), the NAIC’s Accounting Practices and ProceduresManual, and DOI regulations and instructions.1.2.1.2. Review policy forms, rate filings and rating systems of insurers.1.2.1.3. Evaluate the compliance of insurers with the Alabama Insurance TradePractices Law and agent/producer licensing statutes by reviewing the insurer’sclaims handling, payment practices and agent/producer licensing compliance.1.2.1.4. Conduct examinations of surplus line brokers.1.2.1.5. Investigations of possible civil and criminal violations.1.2.1.6. Such other services within the scope of the described services as maybe determined by the DOI.1.2.2.The DOI expects the examinations will relate to selected insurers covering threeto five year periods ending December 31, 2019, and December 31, 2020. A copy of alldocumentation relative to the task assigned will be provided at the date of assignment. 1.2.3.As may be necessary in the context of a particular examination, Contractor shallcoordinate the activity of all National Association of Insurance Commissioners (NAIC)zone examiners.1.2.4.For each examination, the contractor will prepare an examination report inaccordance with the NAIC’s Market Regulation Manual, the NAIC’s Financial ConditionExaminers Handbook, the NAIC’s Accounting Practices and Procedures Manual, anddirections of the DOI. As may be necessary in the context of a particular examination,Contractor may only be required to provide a written report of findings to be incorporatedinto the report of examination of the insurer.1.2.5. As may be necessary, Contractor shall make available one or moreknowledgeable representatives to provide testimony and evidence in any administrativeor court hearing or proceeding arising from Services performed by Contractor.1.2.6. The contractor shall use TeamMate®, a Wolters Kluwer proprietary softwaresystem designated by the DOI for workpaper preparation. At its expense, the contractormust have or acquire a license to use the system. The contractor must enter into, orhave previously entered into, a confidentiality agreement with the DOI (Exhibit “B”attached) confirming the manner in which the contractor will use the TeamMate®software system.
