Specifications include, but are not limited to: A hearing officer is needed to assist the two boards with conducting the hearing, and also providing legal advice to the two boards. 1. To assist the Board of County Commissioners by being the presiding officer during a hearing before the Board of County Commissioners or the Jackson/Teton County Housing Authority Board. 2. To coordinate with the County Clerk regarding the process for filing documents, exhibits, and orders. 3. To conduct the oral arguments of the appeal or presentation of evidence/argument in a contested case, with the Board of County Commissioners or the Housing Authority Board present en banc to hear the oral arguments based on any briefs filed in the appeal or to hear the evidence and argument in a contested case; and 4. To independently conduct without the Board of County Commissioners present, and rule and issue decisions and orders on such matters other than the "final decision," a. Pre-hearing matters, scheduling conferences with counsel, and continuances (as contemplated Teton County Board of County Commissioners Rules for Contested Case Practice and Procedure, Chapter 2, Sections 4 and 5); and b. Briefing Schedule for the parties to submit briefs to the Board of County Commissioners to assist the Board of County Commissioners in reviewing the “written record only in such matter.”; and c. Other matters, to the extent stipulated by the parties to the case. 5. Provide legal counsel to the Board of County Commissioners or Housing Authority; and 6. If the Hearing Officer is requested to, and does make, recommendation(s) to the Board of County Commissioners or Housing Authority Board, the recommendation(s) shall be reduced to writing and shall include his reasons (i.e. the factual basis) for his recommendation(s); and 7. Addressing other matters related to this appeal, on behalf of the Board of County Commissioners or Housing Authority Board, including but not limited to, conducting preliminary hearings, participating in scheduling conferences with counsel, reviewing pleadings filed herein, and/or review of the record in this appeal.
