Specifications include, but are not limited to: The Contractor will be available on an as-needed basis to provide legal services to the VOSHA Review Board (VRB). The Hearing Officer will work closely with the VRB Clerk to help reduce time and costs on any matters before him/her. The services and products to be provided include but not limited to the following: 1. Contractor’s primary responsibility will be to serve as the presiding Hearing Officer in contested VOSHA cases conducting evidentiary hearings in a quasi-judicial administrative law capacity. As presiding officer, Contractor will oversee the prehearing process, establish scheduling orders, resolve other prehearing issues such as discovery. In addition, hearings will be conducted in accordance with the VRB Rules of Procedure, Vermont Rules of Civil Procedure and Vermont Administrative Procedures Act. Hearings will take place at 13 Baldwin Street, Montpelier, VT 05602 unless otherwise ordered. Timeline for completion of a decision is 90 days from the filing of briefs, unless specified differently in the VRB Rules of Procedure or otherwise agreed to timeline by the VRB Chairperson and/or Clerk. 2. Contractor may also be called upon to act as a consultant to provide advice and/or write a decision for the VRB during discretionary review as long as the contractor did not provide services as a Hearing Officer for the same case. 3. Contractor may also act as a settlement judge, providing prehearing mediation and/or direction. 4.
