Specifications include, but are not limited to: Hearing officers for formal adjudications regarding ambulance and paramedic provider selection (and/or serve as presiding officers in informal hearings as needed). 1. Vendor will serve as a hearing officer for formal adjudications. Vendor may be asked to serve as presiding officer for informal adjudications (at the Department's discretion and subject to vendor availability). 2. Vendor is required to conduct all necessary pre-hearing conferences. At least one pre-hearing conference should be held to narrow issues, stipulate facts, and address relevant discovery. Subpoenas may be issued on behalf of the Department if the Vendor and the Department agree that subpoenas are necessary for the proceedings. The formal hearing process is governed by the Utah Administrative Procedures Act (Utah Code 63G-4), Utah Code 26-8a-406 through -409, and Utah Administrative Rules R426 and R380-10. 3. Vendor is required to preside over public convenience and necessity hearings and other related hearings where the parties present evidence, argument, or comment to the hearing officer or the Department. An evidentiary hearing and public comment may be conducted separately, if the Vendor and Department agree that is necessary.
