Specifications include, but are not limited to: a. As-Needed Remediation Services. Company will provide the necessary personnel, supervision, tools, equipment, and materials to perform remediation services for projects within the CPS Energy service area on an as-needed basis. A list of CPS Energy industrial and municipal facilities is provided as Exhibit C. The majority of the work is anticipated to be remediation projects conducted under and in compliance with Texas Commission on Environmental Quality (“TCEQ”) Risk Reduction Program rules and Environmental Protection Agency (“EPA”) PCB regulations under the Toxic Substance Control Act (“TSCA”), 40 Code of Federal Regulation 761. b. General Environmental Contracting Services. The Company may also perform general environmental contracting services. General environmental contracting services may include, but are not limited to, underground storage tank removals; abatement of asbestos-containing materials; building demolition; decontamination of equipment, tanks, sumps, or drains; pumping of contaminated water; or any other environmental service that requires materials, labor, and equipment for various other projects as required by the CPS Energy Field Representative. c. Transportation and Disposal of Waste. The Company may also be responsible for arranging for the transportation and disposal of waste. i. Company is responsible for proper placarding of the transport vehicle. ii. Rolloffs and other waste containers shall be lined with visqueen. iii. The Company shall weigh each of its vehicles used for hauling waste materials at a certified scale which is agreeable to both the Company and CPS Energy before and after loading. CPS Energy reserves the right to have a CPS Energy representative present during the weighing iv. The Company shall provide CPS Energy with copies of the certified weight ticket and shall keep records of the differences in weight of such trucks or other vehicles before and after loading. Such differences are presumed to be the weight of the waste material removed by the Company. v. The vehicle shall not transport other waste or loads while transporting the waste under this project. The generator’s initial copy of each manifest shall be presented to the CPS Energy representative prior to transportation of the load that is being manifested. vi. TSCA-regulated wastes containing PCBs shall be disposed in a TSCA-approved and CPS Energy pre-approved landfill or disposal facility. All other wastes requiring disposal or recycling shall be disposed or recycled only in CPS Energy pre-approved landfills or recycling facilities. It is the Company’s responsibility to obtain this approval before any materials requiring disposal or recycling are generated. vii. The Company shall ensure that all waste and recycled materials are promptly removed from the site and transported for disposal or recycling. viii. CPS Energy will be the generator of all waste and recycled material.
