Task 1 - NESHAP Compliance Asbestos Survey The National Emission Standard for Hazardous Air Pollutants (40 CFR 61, Subpart M, known as NESHAP) requires that a structure, or affected part of a structure, must be “thoroughly inspected” to identify asbestos-containing materials (ACM) prior to renovation or demolition activities. In addition to the federal requirements, the Texas Asbestos Health Protection Rules (25 TAC 296 known as TAHPR) require that pre-renovation and pre-demolition surveys be performed in general accordance with the protocols outlined in the Asbestos Hazard Emergency Response Act (40 CFR 763, Subpart E, known as AHERA) with the additional requirement that at least three samples be collected from every suspect ACM. Suspect building materials that are not sampled by a Texas Department of State Health Services (TDSHS) licensed Asbestos Inspector prior to renovation/demolition activities must be presumed to contain asbestos and addressed in accordance with all local, state, and federal regulations. The asbestos inspection consisted of the following: • Bulk samples were collected and analyzed to confirm or rebut the presence of asbestos within the samples collected. The screening was limited to accessible building materials to be impacted by planned renovations.
