Specifications include, but are not limited to: The University intends to establish an exclusive multi-year agreement with a qualified provider for beverages through campus vending machines and for sole pouring rights. 1. Products • The vendor, subject to University approval, shall provide adequate quality controls regarding products offered. This shall include brands, temperature or environmental controls and when applicable proper rotation of stock. • The products offered and sold through vending machines under this agreement shall be in plastic bottles or cans. Vendors should provide recommendations as to the proper mix of 20 oz. bottles and cans or other sizes as may be available. • Vendor is to provide a listing and description of products offered. • All products offered shall be nationally advertised and first-rate quality. Only top of the line, popular brands are acceptable 2. Service • Information stickers, supplied by the vendor, must be attached to all vending machines. These stickers shall indicate that repair and maintenance service calls should be placed to the University Representative during the normal business hours. • All product delivery vehicles and maintenance vehicles operated on the University campus shall have appropriate company signage. • Vendor shall provide on call, as needed, vending and auxiliary equipment maintenance and repair service so as to minimize vending equipment down time should malfunctions be reported. The Vendor shall respond to equipment service and repair calls/reports within a minimum of eight (8) hours between the hours of 7:00 a.m. and 7:00 p.m., Monday through Friday and twenty-four (24) hours response time during weekends. Equipment which cannot be returned to full service within 72 hours of notification of needed repair shall be replaced with comparable equipment of like quality until the original equipment is returned to service. • Provide the percentage of gross sales to be paid to the University • Provide a listing of universities and colleges in the Middle Tennessee area presently servicing. • Provide plans for improving or expanding vending service on campus. • Submit brochures, photos of vending machines to be installed. • Provide plan for refunds. • Provide plans for timely replenishing products without having to be notified 3. Equipment • Contractor shall provide updated vending machines that accept coins and bills and shall be equipped with change return mechanisms. All vending machines will be equipped with credit/debit card payment options. • The liability for all machines and contents including merchandise or money stored within the machines shall remain the sole responsibility of the vendor. Under no circumstances shall any liabilities whatsoever be accrued against Tennessee State University for damage, pilferage, acts of violence, fire or theft, power failure, acts of God or other acts beyond the control of the University. This is to include liability for damages, injury or sickness due to product spoilage, contamination, etc. Vendor shall stand loss for all slugs and shortages. • Vendor is to describe frequency and process of routine preventive servicing of vending machines. • Future placement of vending machines shall be jointly agreed to by Vendor Management and University Director of Auxiliaries. Removal, addition or movement of vending machines must be approved in writing by the Director of Auxiliaries PRIOR to machine unilateral placement or removal. The University reserves the right at its sole discretion to have any vending machines removed from University property.
