Specifications include, but are not limited to: 1. The contractor shall assume the responsibility and liability for the proper and lawful safe packaging (when applicable) and labeling, transportation, and disposal of all radio active waste materials accepted, except for generator liability as listed under 40 CFR. This contract is for packaging, labeling, transporting, storage and processing of radio active waste material generated by Northern State University. 2. The contractor shall provide competent and properly trained employees for the safe and lawful packaging, labeling, transporting, storage and processing of the radio active waste materials specified. Contractor shall have DOT certification for radio active waster materials. The contractor shall assume full and complete responsibility for the competency, judgment, and actions of said employees at all times, and Northern State University shall neither assume, nor be under any obligation whatsoever for the same. The contractor shall be solely responsible for the actions of, and damage or destruction to, any Northern State University equipment, buildings, or premises and any equipment or facilities leased, lent, or in the care, custody, or control of Northern State University under the terms and conditions of this contract, from the time of receipt by personnel of the contract until the final disposition of the waste chemicals. 3. The contractor shall use sites having EPA permits for treatment, storage, and disposal. Deepwell injection shall not be used for the disposal of any of the wastes covered by this contract. All activities encompassed in the packaging, labeling and transportation of the chemical wastes in this contract shall be accomplished in accordance with all federal, state, and local statutes, laws, rules, regulations and ordinances. Failure to comply with any of the aforementioned statutes, laws, rules, regulations, and ordinances shall be cause for the cancellation of the contract or any resultant agreement. 4. The contractor shall demonstrate the ability to dispose of the chemical wastes covered in this contract. Chemical wastes included are halogenated and nonhalogenated solvent wastes, flammable wastes, corrosive wastes, oxidizer wastes, poisonous wastes, air and water reactives, explosives, cyanide wastes, sulfide wastes and unknowns. Northern State University shall balance its interest in avoiding the use of landfills against any increased cost of alternative disposal methods, as well as the contractor's ability to accept and dispose of the various types of wastes generated by Northern State University. Contractor shall note any exceptions to the types of wastes, which they do not have the ability to dispose of according to all regulatory mandates. 5. Contractor assumes all liability in the event of a spill during the transportation of wastes to a hazardous waste disposal facility and any costs incurred during the clean-up of such a spill to the extent of their insurance limits.
