Specifications include, but are not limited to: 1. Phase 1: Patent/Patent Application Analysis. Create work product that addresses at least the following topics related to strength and quality of the patents/applications: a. Likelihood of Use (current and anticipated) b. Detectability of Use c. Claim Quality d. Patent Priority Strength e. Product Impact (relative claim importance as compared to overall product(s)) f. Market Size (in geographies with issued or pending patents) g. Potential Licensees A report addressing the above and related topics would be owned by PSU and used to determine whether to proceed to Phase 2. 2. Phase 2: Claim Charting. For each potential licensee, develop suitable claim charts related to known or anticipated uses which incorporate issued or pending patent claims. Develop a report work product to be owned by PSU which includes at a minimum: a. Claim strength relative to potential uses b. Merit and likely return on investment for pursuing licensing for potential uses c. A revised list of potential licensees, and an action plan for pursuing licensing The results of Phase 2 will be used to determine whether to proceed to Phase 3. 3. Phase 3: Licensing Support. For each potential licensee that PSU elects to pursue, the successful applicant may be contracted to assist in one or more of: pursuing a licensing strategy, including approaching potential licensees, license valuation support, negotiations, and finalizing contracts for licensing of the patent.
