Specifications include, but are not limited to: The Ohio Department of Commerce (“Department”) requests applications from Ohio-licensed attorneys in good standing to serve as hearing officers for administrative hearings held pursuant to the laws and rules that govern the business of the Department, its Divisions, its Programs, and its Boards, including but not limited to Ohio Revised Code (“R.C.”) Chapter 119. Hearing officers will work on an as needed basis during the term of their contracts. 1. Duties. Each hearing officer shall— • Act as an impartial, semi-judicial factfinder for in-person, video conference, and/or paper-based administrative hearings. Hearing responsibilities include but are not limited to conducting prehearing conferences, making pre-hearing rulings, hearing evidence, overseeing post-hearing briefing, and issuing Reports & Recommendations (“R&Rs”). • Conduct all hearings in accordance with R.C. Chapter 119, other applicable Ohio laws and rules, and guidance issued by the Department. • Timely prepare and issue professional, organized, and typo-free R&Rs following the closing of each hearing’s record. R&Rs typically include some combination of findings of fact, conclusions of law, and recommendations. • Coordinate all hearing activities through the appropriate Division Hearing Administrator. • Submit to the Department clear monthly invoices that track, in 6-minute increments, all hearing officer activities conducted on a daily basis. • Attend all training sessions required by the Department. • Except as otherwise provided by the Department (e.g. recording equipment), supply all electronic tools (e.g. Westlaw, Microsoft Word), equipment (e.g. computers), and materials/supplies (e.g. binders, legal pads, pens) needed to complete the above duties.
