Specifications include, but are not limited to: The contractor is to be approved and licensed by the Ohio Department of Agriculture and shall be responsible for all damages to adjacent crops or claims outside the limits of the ditch banks and easement area. The contractor is limited to the open ditch as a working area. The contractor is also responsible for any part of the right-of-way along the ditch that has been seeded and mulched. The contractor and surety shall save harmless The Joint Board from all suits, actions, claims of any character brought on account of any injuries, or damages sustained by any person or property as a consequence of any neglect in safeguarding the work or through the use of unacceptable materials in the spraying of the Mile Creek, or on account of any act or omission by the contractor or his agents. The herbicide to use shall be GARLON 3A. Any other material used shall be approved by the County Engineer prior to application. A 95% kill of woody plants and broadleaf weeds is required or the contractor shall respray uncontrolled areas at his own costs until the 95% rate is obtained.
