Description

Copies of the Bidding Documents may be obtained upon payment of $50.00 per set, by certified check or money order, non-refundable, payable to Orange County Community College. Partial sets will not be issued.

If Bidding Documents are to be mailed, enclose a separate certified check or money order for postage and handling in the amount of $50.00, payable to Orange County Community College.

Plans, Specifications and Contract Documents for the proposed work are on file and publicly exhibited at Fellenzer Engineering, LLP, 22 Mulberry Street, Middletown, NY 10940. The said plans and specifications may be obtained from Fellenzer Engineering, LLP, 22 Mulberry Street, Middletown, NY 10940, (845) 343-1481, at the above address, in person or by mail beginning Wednesday April 17, 2019. The Contractors shall leave their names and correct mailing addresses with email and phone number upon receipt of the plans and specifications.

All bids shall be sent by USPS, UPS, Fed-Ex, or by hand to Orange County Community College Purchasing Department, 115 South Street, Orange Hall Room 220, Middletown, N.Y. 10940 before 2:00 P.M., prevailing time on Thursday, May 9, 2019 and stamped by an employee. At 2:00 P.M., prevailing time, received bids shall be publicly opened and read aloud. No bid received after 2:00 P.M. will be accepted. The receptionist will direct all attending bidders to the room where the bid openings will be held.

Contractors may contact Fred Brennen at 845-341-4224/4600 regarding how and where to pick up plans at the College.

Each bid from a Contractor must be accompanied by a bid bond or certified check, payable to the OWNER, in the amount of ten-percent (10%) of the total amount of the bid as security therefore. The bid bond or certified check shall be returned or refunded to the bidder on the condition that if the bid is accepted by the Owner, the bidder shall enter into a contract for the same, within ten (10) days after notification of award of contract. If no contract is awarded within 45 days of submittal of the bid, the bid may be withdrawn and the bid bond or certified check shall be returned or refunded. Each proposal must be accompanied by an Offer of Surety (Schedule 1), signed by the bidder and by the proposed surety.

At the time of execution of the Contract, the Contractor shall furnish the Owner the necessary bonds. The required bonds shall be substantially conditioned to provide that the Contractor shall faithfully perform the Contract on his part, and shall satisfy all claims and demands incurred for the same, and shall indemnify the College against any and all claims for damage on account of work performed under the Contract.

The Contractor shall procure and maintain, at his expense, until final acceptance by the Owner of the work covered by the Contract, liability insurance for Workmen's Compensation and for bodily injury and property damage, and said insurance shall be kept in full force and effect by the Contractor by payment of the required premiums during the term of the work performed under the Contract.

Pursuant to General Municipal Law § 108, the bidder stipulates and agrees that any agreement shall be void and of no force or effect unless the person, entity or corporation making or performing such agreement secure compensation for the benefit of, and keeps insured during the life of such agreement its employees, in compliance with the Workers' Compensation Law.

The Contractor shall furnish promptly upon demand by the Owner proof that said insurance remains in full force and effect. The Contractor's failure to procure or maintain said insurance shall constitute an act of default and entitle the Owner to terminate the Contract (as set forth in General Conditions, Article XIII.

All bids shall be submitted subject to the following conditions:

All bid envelopes must be marked with the Vendor Name and Bid Number. It is the responsibility of the bidder to ensure that their Bid is delivered to an individual at Orange Hall Room 220, 115 South Street, Middletown N.Y. 10940. All Bids are to be stamped in at the reception desk.
Bids received after the aforementioned time will not be accepted.
The OWNER reserves the right to reject any or all bids and re-advertise for new bids.
All bidders shall submit proof of responsibility, as required by the OWNER.
Each bid must contain the certificate of non-collusive bidding required by Section 103 -d of the General Municipal Law, relating to non-collusion (Schedule 4 hereto)
The bidder shall make allowance in his bid for any price increase in labor and materials. Requisitions for work and/or material shall be at the price bid with no additional charges for such increases.
All questions are to be submitted in writing by Thursday, May 2, 2019 to Fellenzer Engineering LLP, 22 Mulberry Street, Middletown, NY 10940.
There will be a recommended Pre-Bid Walk-Through and Site Visit on Wednesday, May 1, 2019 at 10:00 AM. Bidders shall meet at Horton Hall Conference Room. All interested parties are encouraged to attend.
