Specifications include, but are not limited to: The contractors shall: 1. Maintain licensure in good standing with the New Mexico State Bar. 2. Not hold any other appointed or elective office or position in government during the term of the contract. 3. Conduct quasi-judicial public hearings on applications for discretionary development approval filed pursuant to the County’s Sustainable Land Development Code (SLDC), as required by the SLDC or as referred to the hearing officer by another decision making body. 4. Conduct quasi-judicial public hearings in an efficient, fair, and orderly manner, consistent with the procedures and standards set forth in the SLDC, the County’s Rules of Order Ordinance No. 2009-2, and applicable law. 5. Make written findings of fact, conclusions of law, and recommendation(s) and file written reports containing such findings and conclusions of law to the Land Use Administrator, Planning Commission, or the Board of County Commissioners, as applicable. Such findings, conclusions, recommendation, and reports must be completed and filed with the appropriate decision-making body or official within 15 business days of the public hearing or such longer or shorter deadline as may be prescribed in the SLDC or established by the Land Use Administrator or designee in writing. 6. Hold regularly scheduled quasi-judicial public hearings in the BCC Chambers for those matters assigned to the hearing officer by the Land Use Administrator on a monthly basis if necessary, on the date and at the time established by the Land Use Administrator. 7. Preside over meetings as described in Chapter 11, Section 11.4.4.9 regarding developments of countywide impact. 8. Hold hearings in the BCC Chambers for those additional matters referred to the hearing officer by the Land Use Administrator, the Planning Commission or the Board of County Commissioners pursuant to the SLDC. 9. Not, during the term of the contract, be employed by Santa Fe County, any political subdivision of the State or New Mexico, or tribal government the geographic boundaries of which are located either wholly or partly within the geographic boundaries of the County, or be employed by a governmental entity from which the County requests opinions pursuant to Sections 4.4.7 and 5.7.5.1 of the SLDC. 10. Not, during the term of the contract, represent persons or entities with regard to land use applications submitted to Santa Fe County or in appeals of or lawsuits regarding land use decisions of Santa Fe County. This prohibition applies both to the appointed hearing officers and the hearing officers’ firms.
